By the end of the summer of 2013 it began to emerge that the Parti Quebecois,  the political party in control of a minority government at the time, was about to propose a discriminatory bill that would have banned people of ethnic backgrounds from adorning religious garb or symbols if they work in an environment that receives public funding, under the guise of a “secular” charter, in what was considered to be a strategic maneuver by the political party to gain a majority government in the next election by creating wedge politics and using a right wing approach to promote Quebec identity on unilateral nationalistic grounds at the expense of  pluralism and multiculturalism.

As the political and social climate degenerate into a polarised society and as the public discussion on the charter spiraled out of control and became more racist and xenophobic, 99%Media initiated and collaborated with G.A.P.P.A and Les Alter Citoyens, two partner independent media groups, to produce a feature documentary that joined the opinions of First Nations, immigrants, historians, social scientists, philosophers, lawyers, psychologists, economists and political scientists. “La Charte des distractions”  as the documentary was titled, detailed all that was wrong with the proposed “charter of Quebec values” as the bill was first named, and why it was a distraction from the real issues that are plaguing Quebec society.  As with “DÉRIVES”, the documentary was initially produced with a zero budget, and was released freely to the public. However, a crowd funding initiative was started close to the end of production to raise $3,283  in order to cover some costs for translation and subtitling, renting of a theater for the premier, and other related costs.

The documentary received critical acclaim even by mainstream journalists, and was independently screened by citizen initiated public viewings at colleges, universities, pubs, clubs and documentary film festivals across Quebec, it has also been selected for festivals outside of Quebec and Canada, and has also received requests to be used as supplementary educational material at university level sociology, media, literature, and political science classes across academic institutions in Quebec.

Un film objectif ? Non, pas du tout. Il ne prétend surtout pas l’être. Le film est une prise de position et non un reportage objectif qui donnerait la parole aux deux camps. […] Le but ? Contribuer au débat en faisant contrepoids aux discours officiels. A Collaborative Project

From the beginning, the documentary project was constructed on a strong collaborative base between the three media groups. A structure of horizontal direct democracy was implemented in order to maintain a collective  view rather than an individual one. The experience was  a model of success and an exercise in how media groups can cooperate in order to produce something bigger than their individual self.

The DGEQ

When the Quebec government declared an election, the collective of three media groups released a short documentary made out of excerpts of interviews from “La Charte des distractions” that detailed the manner in which the bill tabled by the PQ administration was nothing more than wedge politics. The short documentary, entitled “La Charte des élections” (The Charter of Elections), was subsequently censored by le directeur général des élections du Québec (DGEQ) as an “unauthorised electoral expense”, failing to recognize the collective as independent media exempt from the electoral law.

En permettant à tous de devenir des « médias », on peut aussi s’inquiéter que de puissants groupes de pression ou des corporations puissent passer des ententes avec des partis politiques pour les favoriser ou défavoriser leurs adversaires. Il est plus facile d’être sympathique à la cause d’un média « citoyen » qui diffuse la position d’intellectuels issus de divers milieux. On pourrait sourciller si une puissante compagnie pétrolière engageait des millions de dollars pour tapisser la provinces d’affiches pour vanter les mérites d’un politicien ou d’un parti. Ces questions ne sont pas à prendre à la légère et nous convient à une réflexion sérieuse dans un contexte médiatique désormais fort complexe.

Mais faute de se pencher sérieusement sur ces questions à l’ère des médias sociaux, le DGE me semble bien mal avisé de sommer un média citoyen de se comporter autrement que tous les autres médias qui, pour la plupart, appartiennent à de grandes corporations. The collective fought back and won, the DGEQ reversed its decision, apologised and formally recognised the collective as “non-traditional media” groups.

This was a major victory, not just for 99%Media, G.A.P.P.A and Les Alter Citoyens, but for all independent media groups and independent journalists across Quebec.

Je suis d’avis que le DGEQ a pas mal de pain sur la planche afin de pouvoir bien faire son travail dans ce nouveau contexte médiatique (qui n’est d’ailleurs pas si nouveau que ça). La loi elle-même manque définitivement de précisions et semble désuète tandis que le comportement des politiciens et des partis sur les médias sociaux semblent tout à fait échapper aux pratiques que les instances légales voudraient encadrer. Vivement une réflexion sérieuse à ce sujet avant les prochaines élections afin que les règles soient claires et justes pour tous. Simon Jodoin, Voir Montréal – 06-04-2014
